Giorgi Papuashvili would better answer the questions about ongoing investigation in the Prosecutors Office of Georgia against him and return the property

The organization responds to Giorgi Papuashvili’s comment of September 18, 2015, made to the journalists by the President of the Constitutional Court of Georgia, where he states, that “each and every property owned by him is legal” and the disputed property, owned by Roland Bladadze in Batumi, Gorgasali st.#37, is now also under his legal ownership.  

Young Barristers urges, that GIorgi Papuashvili is trying to address all questions asked by Roland Baladadze’s advocates to the Government, which leaves an impression of biased vies over the case. The organization considers it necessary to explain to the media and the society all the circumstances in which the disputed property was transferred to Giorgi Papuashvili’s ownership. In particular, in September, 2014, the Court has satisfied a motion of the Prosecutor’s Office of Adjara and confiscated the property owned by Roland Bladadze as illegal and unjustified. The dispute in the Common Courts to return the property was carried on by Roland Bladadze without a success. On June 6, 2007, mikheil Saakashvili’s decree on the “Privatization of the State Property through the direct sale method” was enforced and the property owned by Roland Bladadze was bought by Giorgi Papuashvili, the President of the Constitutional Court of Georgia for symbolic price, 1000 GEL. The latter can’t be regarded as the legal owner of the property due to the following circumstances:  Giorgi Papuashvili was well aware of the fact that the family made the real estate disputed, he knew all those illegal circumstances, in which the property had been confiscated from Roland Bladadze’s legal ownership. The property was given to Giorgi Papuashvili on June 16, 2007, however, the information about the real estate being disputed was available for every person involved in the process of decision-making, including Mikheil Saakashvili, the former President of Georgia, to whom the family of Baladadze appealed on May 11, 2007. The content of this appeal shows that the Bladadze’s family already knew, that their property will be transmitted to Giorgi Papuashvili. In addition to this, the letter of June 18, 2007 by the Chairman of the Human Rights and Civil Integration Committee and the letter of June 20, 2007 by the Chairman of the Legal Issues Committee of the Parliament of Georgia to all decision-making authorities suggested, that Roland Bladadze’s property was problematic, the issue should be researched thoroughly before making any decision with regard its further disposal.   On December 9, 2014, Elene Tevdoradze, the Chairman of the Human Rights and Civil Integration Committee of the Parliament of Georgia of that time, noted during her interview to the TV channel “Obieqtivi”, that before Roland Blaldadze’s  Property disposal, she had met with Giorgi Papuashvili and explained the problematic issue of this property.  However, it didn’s stop Giorgi Papuashvili to get this property and live there until now.

Objective investigations over the case since October 1, 2012 made it obvious, that criminal case against Roland Bladadze initiated in 2004 and the seizure of this property on the ground of groundless accusations, was intentional and unjustified.  The resolution of April 12, 2013 of the Prosecutors Office of Adjara stopped criminal proceedings against Roland Bladadze, creating sufficient ground for claiming illegally seized property back. In October, 2014, the NGO Young Barristers prepared a research, “System against the Citizen”, related to the fact of Giorgi Papuashvili’s residence in the property confiscated from its legal owner. The research gained attention from different International Institutions, however Giorgi Papuashvili is trying to hide the problem. In March 16, 2015, the organization published information about ongoing investigation in the Prosecutor’s Office of Adjara against Giorgi Papuashvili on the issue of misappropriation of the garage owned by Roland Bladadze.  After this, on March 17, Giorgi Papuashvili decided to sell disputed property to his relative, ex-husband of his wife’s sister, Giorgi Levidze.

Young Barristers keeps on defending Roland Bladadze’s legal interests and will publish all the new evidences related to the case. Currently, the case of disputed property is being considered in the Department to Investigate Offences Committed in the Course of Legal Proceedings.
