Young Barristers give recommendations to the Minister of Education Giorgi Margvelashvili

Organization Young Barristers requires more transparency and enlargement of competence of the special committee reviewing cases of persons dismissed for political reasons from Resource Centers and public schools. Organization has already addressed an appropriate recommendation to Giorgi Margvelashvili, Minister of Education and Science of Georgia, however official explanation has not yet been made.

Young Barristers had fully acquainted with the information received from the Ministry, linked with the commission’s principles and rules how the decisions are made. Based on this information we express our opinion that the committee reviewing cases of persons dismissed for political reasons from Resource Centers and public schools works with the gaps.

Young Barristers think that coming out from the realty and due to the fact that before October1, 2012 there have not been left almost any educational institution for which the facts of political relieving and discrimination is uknown, the Ministry of Education and Science should enhance commission’s tasks, rights and responsibilities in order to make the Ministry’s approach comprehensive and fully sharing to the principles of justice.

Young Barristers come out with the proposal to make changes in the Minister’s order #1374 linked with the formation of the commission studying the facts of political relieving and to give the committee right to adopt the facts of political discriminations held from January 1, 2006 till the time of commission formation (December 12, 2012) at professional colleges subordinated by the Ministry.

The study of the committee’s activities revealed that there are facts when people relieved for political reasons are applying, however since its rights the commission is powerless to make concrete decisions. Consequently, it fails to meet the principles of justice recovery and so we think that the Ministry should also begin the study of political discrimination facts at professional colleges.

As for the Universities, our organization has a clear position that the committee should not discuss the cases of political discriminations at Universities and we think that the Court should study such cases and the committee should not fully delegate.

Young Barristers have also asked the Ministry of Education and Science to make public the information about the committee decisions. In particular- how many relieved persons were restored on their positions after the committee’s decision, how many applications are already registered at the committee, how many of them are already satisfied and what is the geographical areal of the applications.

We think that such information is important in order to give public ability assess the effectiveness of the committee’s work.

Please note that Young Barristers had initially welcomed the decision to establish such committee and still expresses its position that since the governmental changes in October 1, 2012 the decision to form such commission is timely and appropriate.

However the effectiveness of the committee’s work still remains a significant issue for us. The committee that has already discussed 667 applications and responded its authors that undoubtedly indicates the amount of activity it has already implemented leaves the information about consideration of its decisions unknown.
