The Court will resume the dispute towards Tamar Chergoleishvili on November 12

Tbilisi City Court will resume the dispute on the lawsuit of the “Young Barristers” towards the director of “Tabula” - Tamar Chergoleishvili on November 12 , 2014, 16:00. The first session had already conducted, in which the parties presented their argumentation. The court offered the settlement to the parties to which the co-founder and chief executive of the "Young Barristers” – Archil Kaikatsishvili agreed. According to the mothin of the plaintiff, the Court has announced a break in the session, during which, the lawyer who protects Tamar Chergoleishvili communicated to her on the terms of the settlement. Ultimately, Tamar Chergoleishvili refused to have settlement with "Young Barristers" pointed out that the statements made towards the organization in the public space was in the category of assessment. According to the lawyer, "Tamar Chergoleishvili assesses the claim of the "Young Barristers" as an action against the freedom of media and freedom of expression." This evaluation was replied by archil Kaikatsishvili, that “should determine the context of statements of Tamar Chergoleishvili, in which some uttered phrase ws estimation, some of the incriminating and  damaging the business reputation of the organization. According to Archil Kaikatsishvili, the action of the “Young Barristers” to protect their civil right in court is a desire to set a precedent in similar cases and not the influence towards the freedom of expretion. "I will be the first one to support Tamar Chorgoleishvili if their media activities, unreasonably be threatened" - said Archil Kaikatsishvili.

The “Young Barristers” demand from the court to impose Tamar Chergoileishvili to deny the organization’s business reputation damaging statements, in particular:

  • The defendant’s statement made in "Rustavi 2", in“Kurieri” at 21:23, on 5 February, 2014: "Of course, this is a calumny, launched by the activists of Georgian Dream - the "Young Barristers” – said Tamar Chergoleishvili. The defendant, due this statement, should reject the above-mentioned statements, facts, that the organization “Young Barristers” are the activists of the "Georgian Dream" through "Rustavi 2", in“Kurieri”;
  • On 30 January, 2014 the defendant Tamara Chergoleishvili should reject a statement on her own page in social network "Facebook": "Dream Activists got intimidated ..." The defendant, due this statement, should reject the above-mentioned statements, facts, that the organization “Young Barristers” are the activists of the "Georgian Dream"

The first official position of defendant Tamar Chergoleishvili, on the claim of the “Young Barristers”, is already known. On 20 June 2014, the director of "Tabula" Tamar Chergoleishvili submitted a counter-claim, according to which she is not going to deny business reputation infringing information towards the plaintiff organization. Defendant party, highlights the fact that issues related to all the factual circumstances of this dispute is in the public interest and the issue should be discussed in the context of public discussion.

For more infomarion: the “Young Barristers” has filed a lawsuit in Tbilisi City Court, against Tamar Chergoleishvili on May 7. The criticism of Tamar Chergoleishvili followed to the published research: "Property declaration of politicians and their hidden business interests", where the discussions focused on defendant's husband, Giga Bokeria’s family-related firms’ income. The interests of the organization will be protected on trial by the foundation board of the organization - Archil Kaikatsishvili, Marika Arevadze and Tinatin Nibloshvili.

The court accepted the case, and civil litigation will be heard by the judge -Tamaz Urtmelidze.
