“Young Barristers” appeal to the Ministry of Education for starting reaction on the fact of setting free Levan Kikvidze

“Young Barristers” assesses the fact of setting Levan Kikvidze- history and state and citizenship teacher at # 51 G. Tabidze Public school - free as direct interference and discrimination of liberty expression and will protect teachers’ rights at any stage. The organization appeals to the Ministry of Education and Science of Georgia with official letter connected with the fact of Levan Kikvidze’s compulsory leaving public school and demands to study the legality of the activity of director immediately and to set legislative results.

On 27th of May, 2012 Levan Kikvidze participated in opening of pre-election company planned by oppositional-political coalition “Georgian Dream” in Tbilisi. He carried out civil activity and called his friends in social networks to attend mentioned activity. Later Levan Kikvidze spread photos of meeting and even his own photo being in the shirt of political coalition in social network.

On 28th of May Levan Kikvidze left massage on his own page. Privately, teacher responded to the fact of dismissing Maia Miminoshvili – director of national examination centre and admitted that mentioned decision “was the next immoral act from the government”(style is kept). Kikvidze uploaded the photo of Maia Miminoshvili on his page as the sign of solidarity.    

On 29th of May during the lesson Levan Kikvidze was informed that school director David Lagvilava wanted to see him. Director demanded explanation from the teacher for participation in the activity of Election Company of May 27 and for supporting Maia Miminoshvili and advised him to write a statement and leave school. Director talked to the teacher in presence of photos and massages published in internet. According to Levan Kikvidze director’s position was a teacher to wait for changing of government and continue his activities after new government. Kikvidze didn’t agree with the director and pointed that he acted in the frames of freedom expression on 27th of May and didn’t intend to write a statement for leaving school. 

On 30th May there was the next meeting of Levan Kikvidze and school director. The teacher informed school director that he felt insulted and didn’t have calm pedagogical surrounding; he felt that he was discriminated and took the decision of leaving school. During the speech director mentioned that he would explain the fact of leaving Kikvidze legally as his labour contract was expired and school wouldn’t continue his pedagogical activity as he hadn’t passed the pedagogical certification certificate. For notification: Levan Kikvidze had labor contract till September 15, 2012 and according to the law it is not obligatory to pass pedagogical certification exam till 2014.

On1st of June Levan Kikvidze went to school to pass official statement to director connected with ceasing pedagogical activity, though teacher wasn’t let in school by guard service. School director David Lagvilava responded to the accusations of a teacher by media and admitted that “will not make a commentary on teacher’s foolishness”. In newspaper “Resonance” of June 1, school director says about Levan Kikvidze “As it seems he had problems. Kikvidze is like inadequate man” (style is kept).

According to the organization assessment there are enough proves that school teacher was dismissed from public school due to his political opinions. The action of school director makes many questions. Moreover, director’s relation makes discrimination to pedagogical future of Levan Kikvidze, as the greatest legislative kindness of teacher is destroyed – it is possible that neither school will agree to start new labour relation with Levan Kikvidze.  By our assessment school director violated the paragraph-3 of labour contract with a teacher himself when employer took obligation to carry out rights granted by constitution and freedom protection, respect to his dignity and not to let any base for his discrimination.

Levan Kikvidze has grant scholarship of the president of Georgia and Eurocommission and worked at #51 Tbilisi public school from November 2011, is participant of 12 scientific local and international conferences, is the author of 14 scientific and publication articles, composer and redactor of 2 scientific and 2 literary collection works. He is a graduating student of diplomacy faculty of humanitarian sciences and international relations of Ivane Javakhishvili Tbilisi State University, master of social sciences of the faculty of management and economics at Latvia State University, doctoral candidate of social and political sciences of TSU. He knows English, Russian and Latvian languages.

“Young Barristers” sent massage to pedagogical international unions about the fact that happened and appealed Latvia State University as well in order to get exact and complete information about education, competence and qualification got in Europe by Georgian teacher, whose abilities turned out to be unconvincing for school director.
